DOC determined that in this POR20, many pangasius fillet exporters from Vietnam, including Bien Dong and Vinh Hoan, did not dump their products into the US market. Therefore, they will not be subject to any anti-dumping tax. There are 8 pangasius exporting companies eligible for separate tax rates, including: Vinh Hoan Corp, Bien Dong Seafood; CASEAMEX, DAI DAI THANH SEAFOODS, DONG A SEAFOOD; Hung Ca 6 Company; NAVICO; and NTSF SEAFOODS.
Since the United States considers Vietnam a non-market economy, DOC uses surrogate values of third countries to calculate the dumping margin for Vietnam. In this review, DOC selected Indonesia as a surrogate country to calculate the dumping margin for pangasius because DOC believes that: 1) Indonesia has a similar economy to Vietnam; 2) Indonesia significantly produces goods similar to the goods under investigation during the review period; 3) Indonesia provides usable and reliable data to help DOC assess Vietnam's production factors.
DOC will announce the final anti-dumping tax results 120 days from the date of announcement of the preliminary results.
Preliminary results of the anti-dumping tax on Vietnamese pangasius fillets exported to the US in POR20 (August 1, 2022-July 31, 2023).
