Termination of CVD lawsuit against frozen warmwater shrimp from Vietnam

(vasep.com.vn) On 20th of September 2013, the United States International Trade Commission (USITC) determined that a U.S. industry is neither materially injured nor threatened with material injury by reason of imports of frozen warmwater shrimp from China, Ecuador, India, Malaysia, and Vietnam that the U.S. Department of Commerce (US DOC) has determined are subsidized.

Commissioners Daniel R. Pearson, Dean A. Pinkert, David S. Johanson, and Meredith M. Broadbent voted in the negative. Chairman Irving A. Williamson and Commissioner Shara L. Aranoff voted in the affirmative.

As a result of the USITC's negative determinations, US DOC will not issue countervailing duty orders on imports of these products from China, Ecuador, India, Malaysia, and Vietnam.
This is the next positive result for Vietnamese shrimp exporters after the final results on the antidumping duty on imported frozen warmwater shrimp from Vietnam for the period of February 1, 2011, through January 31, 2012. Accordingly, DOC determined that in the seventh administrative review (POR7), sales by 33 Vietnam shrimp exporters to the U.S. market have not been made below normal value. Thus, the 33 exporters get zero average dumping margin.
The USITC’s determination is reaffirmation that Vietnam shrimp exporters have been operating under market mechanism, and have never been receiving any government subsidy. As the results, Vietnam shrimp enterprises and shrimp products originated from the country must be obviously treated impartially, objectively in compliance with the spirit of trade liberalization and fair competition as well as vibrant trade relationship between Vietnam and the U.S.
