According to C-Food International SAL (Off-Shore) representatives, the trademark “Siblou” is the ownership of C-Food International SAL (Off-Shore) and is registered as such in Vietnam and Iraq, However, it has come to their attention that counterfeit (fake) products using the “Siblou” trademark are being manufactured in and exported from Vietnam and sold in the Iraqi market and other markets. C-Food International SAL (Off-Shore) announced to take proper and severe actions against the manufacturers, exporters, importers, distributors and/or sellers of the abovementioned counterfeit products in any jurisdiction or market and/or any other person, party and/or entity involved in such counterfeit activity.
The sole entities which are entitled to manufacture, import, export, distribute and sell any product under the trademark “Siblou” are C-Food International SAL (Off-Shore) and Sailex Overseas Ltd.
The abovementioned products are a counterfeit of the products manufactured by C-Food International SAL (Off-Shore) and Sailex Overseas Ltd. under the trademark “Siblou” and are a threat to the consumers. Manufacturing and selling counterfeit products is illegal and punishable by civil and criminal courts according to the consumer laws, trademark, copyright and intellectual properties laws and regulations in Vietnam and Iraq, including the Law on IP. Such counterfeit activity is causing irreparable harm and damages to C-Food International SAL (Off-Shore) and Sailex Overseas Ltd.
C-Food International SAL (Off-Shore) shall take all legal measures and actions to protect itself from any demand, action or claim resulting from the consumption of the abovementioned counterfeit products by the consumers and to prevent the infringement of its intellectual property rights with regards to the “Siblou” trademark.
In light of the above, we hereby request an immediate termination of all of infringing acts of our intellectual and industrial property rights to our protected trademark “Siblou”, including, but not limited to, the following acts:
(i) Affixing the sign identical with or confusingly similar to our trademark “Siblou” on goods, goods packages, business facilities, means of service provision or transaction documents in business activities;
(ii) Circulating, offering, advertising for sale or stocking for sale goods bearing the sign identical with or confusingly similar to our trademark “Siblou”;
(iii) Exporting or importing goods or services bearing the sign identical with or confusingly similar to our trademark “Siblou”.
C-Food International SAL (Off-Shore) has already taken and is still taking the necessary measures in respect of the above against the infringing parties of its protected trademark, and hereby issues a general warning to any manufacturer, exporter, importer, distributor and/or seller of the counterfeit products using the “Siblou” trademark which are being manufactured in and exported from Vietnam and any other jurisdiction and sold in the Iraqi market and other markets, to refrain from any such activity and to withdraw any of the aforementioned counterfeit products from the markets and destroy them immediately, failing which C-Food International SAL (Off-Shore), owner of the “Siblou” trademark, shall have no choice but to take any and all appropriate actions and measures before civil and criminal courts, including injunctions, coercive measures and actions against the properties and assets of the infringing parties, to protect its intellectual property rights, to protect itself from any action, claim or demand filed by any of the consumers of such counterfeit products, and to seek compensation for the irreparable harm and damages that such counterfeit activity is causing to C-Food International SAL (Off-Shore) and Sailex Overseas Ltd.
